"The basis of the Florida case, that's something we've anticipating being problematic in our state as well," she says. "They've already found standing to file suit, but in our case, we do not know of any cases yet. But we anticipate those same issues to arise."
But Joe Follick, a spokesman for the department, said the ruling was good news for Florida. "We're very pleased with the judge's decision. The winners here are teachers, parents and students who can work together in an atmosphere where the best educators in the country can thrive."
Cooper found the law "facially constitutional and constitutes a lawful delegation of legislative authority." The Florida Education Association brought the suit on behalf of six Florida teachers...
"We have an approved teacher evaluation system that's approved by the department of education...It bases the classroom observations with the piece around scores, and student performance, and student achievement" said Leon County Schools Assistant Superintendent Scotty Crowe
