"Flagstar "took excessive time to process borrowers' applications for foreclosure relief, failed to tell borrowers when their applications were incomplete, denied loan modifications to qualified borrowers, and illegally delayed finalizing permanent loan modifications." As a result, "struggling homeowners lost the opportunity to save their homes," says CFPB Director Richard Cordray. Furthermore, the CFPB says similar actions against mortgage servicers will be taken across the country, including in Louisiana, if servicers fail to follow the rules that went into effect at the beginning of this year. "The bureau has been clear that mortgage servicers must follow our new servicing rules and treat homeowners fairly," says Cordray, adding "today's action signals a new era of enforcement to protect consumers against the cost of servicer runarounds." Most mortgage servicers have an incentive to work with struggling borrowers to minimize losses, and the Flagstar situation is an exception to the rule, but area homeowners who are having trouble with a problem mortgage can find a local HUD-approved counseling agency by visiting the CFPB website and learning about the process."
