More importantly, what would history say? This is what I worry about when I worry about whether a war is just or not. I don't just worry that the war might be unjust. If that were the case, my doubts might be enough to get me to quit. I also worry that it is just. If that were the case, giving in to such doubts would be an act of cowardice."
Most importantly, making human rights optional sends a dangerous message to other states. As Koh explained, "The denial of the legal obligation invites suspicion and distrust from our audiences, domestic and foreign." This double standard provides a potential excuse for other states to opt out of their obligations, undermining the larger international human rights...
